How do I get eFile access?
Please talk with your Account Manager, who will provide additional details on our eFile offering. If you do not have an Account Manager, please contact us at support@proofserve.com to discuss interest in this service.
How do I select eFile during the serve creation?
At Proof, depending on what options are enabled on your firm account, we can assist with filing cases or affidavits electronically. Please note that these steps will only appear for customers who have eFile access with Proof. Refer to your agreement or account details for specific pricing.
During serve creation, once you get to Step 4: Serve Speed and Add-ons, please select the appropriate Serve Speed for this address. After your selection, the platform will immediately provide you with options for Add-Ons.
There will be two Add-ons to choose from: Case Filing and File Affidavit.
Case filing means you are requesting Proof to initiate a new case filing on your behalf. If you have already created a case with the court, do not select this option.
Filing affidavits means submitting proof to the court that service was completed using the affidavit obtained by Proof. When selecting this option during serve creation, it means you've already submitted documents to an existing case filing and are only requesting Proof files the proof of service after the serve is completed. Please do not select this option if you prefer to submit the affidavit on your own, instead of Proof.
In both options, Proof uses the appropriate court filing system and follows the state, court, and client requirements for how that filing must be submitted.
🚧 Please be mindful that both Case Filing and File Affidavit can be selected, or the opposite, where neither is selected. To ensure the case or affidavit will be filed, the box next to the respective option must be selected on the Add-ons screen before the serve is submitted for service.
Each option will incur a separate fee, which will be added to the serve after the service is submitted. So, for example, if you simply need to have Proof file the affidavit after service is completed, click File Affidavit and not Case Filing.
There are some circumstances where Proof cannot perform either Case Filing or File Affidavit. Or the firm account may have only been set up to perform one of these options. Please make sure to only toggle the option you need for that particular serve.
Refer to your agreement or account details for specific pricing on these add-on services.
What happens if I pick the wrong option?
Please be mindful that if you select the wrong option between Case Filing or File Affidavit, this could cause unexpected delays for the service of process.
For example, if you need Proof to initiate a new case on your behalf and did not select Case Filing as the Add-On service, the submitted service will attempt to find a server to serve any documents attached to the service. Case Filing must be selected, or Proof will proceed as if the documents were already filed with the court.
Please let us know as soon as a serve is submitted via the serve chat if any options were improperly selected or were meant to be selected instead.
